The arbitration will be conducted before a single arbitrator, and will be limited solely to the dispute or controversy between the parties. The arbitration shall be held in a location designated by Shopadise.com, by telephone, or online. Any award of the arbitrator(s) shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. Information may be obtained and claims may be filed at any office of the NAF or at P.O. Box 50191, Minneapolis, MN 55405. You agree that Shopadise.com exclusively reserves the right but not the obligation to transfer and or to litigate any legal action in a court of competent jurisdiction sitting in New York County, New York at any time. You hereby waive your right to a trial and a jury trial in any action with respect to the subject matter of this Agreement. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises. You agree to notify Shopadise.com of all claims within 10 business days or less of learning about them by certified mail return receipt requested.  Shopadise.com ’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Shopadise.com may assign its rights and duties under this Agreement to any party at any time without notice to you.

9. Notice. Shopadise.com may deliver notice to you under this Agreement by means of electronic mail, a general notice on the Service, or by written communication delivered by first class U.S. mail to your address on record in Shopadise.com ’s account information. You may give notice to Shopadise.com at any time by letter delivered by certified first class postage prepaid U.S. mail or overnight courier.

4. Shipping Charges Taxes. Separate charges for shipping and handling will be shown on Shopadise.com, invoice(s). Unless Customer provides Shopadise.com, with a valid and correct tax exemption certificate applicable to the product ship-to location prior to Shopadise.com’s acceptance of the order, the Customer is responsible for sales and all other taxes associated with the order, however designated, except for Shopadise.com, franchise taxes and taxes on Shopadise.com net income. If applicable, a charge for taxes will be shown on Shopadise.com’s invoice.

 

5. Title Risk of Loss. Title to products passes from Shopadise.com to Customer on shipment from Shopadise.com’s location(s). Loss or damage that occurs during shipping by a carrier selected by Shopadise.com, is the customer’s responsibility. Loss or damage that occurs during shipping by a carrier selected by Customer is Customer’s responsibility. Title to software will remain with the applicable licensor(s). We reserve the right to require customer signatures on their shipments to protect the customer’s shipment and ensure customers actually receive their merchandise.  Generally shipments over $100 will require customer signature upon delivery.  We may amend this policy at any time and reserve the right to either require or not require customers’ signatures upon delivery at our sole discretion.

12. Headings. The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom.

 

13. Acceptance. You must return all free and promotional products received in your order to receive a full credit toward an exchange. Unopened merchandise returned to us after thirty days will not be covered under the policy.  Any orders under and or where rebates, discounts, coupons, bulk and or wholesale pricing is applied are excluded from this guarantee. This guarantee offer supersedes any other offers for a refund. To be eligible for the 30 Day Guarantee you must:

Make a written request via email for your credit within 30 days from the date of your order and return your unopened merchandise within this time frame.

Obtain a return authorization code and ship back within 30 days from the date of your order all bottles and products shipped to you in sale-able and sealed unopened condition within its original packaging.

Include your order number, full name and contact information including phone number.

You must be a first time customer of any of our sites and you must have purchased our product(s) directly via our site.

You must return your order in its original unopened sale-able container within 30 days from your order date, with its original packaging.   Your return order must be shipped by you via trackable means.   You shall be responsible for all shipping and handling costs.

Orders already processed cannot be cancelled.      A restocking fee of $10 per item may be applied for any returned products with the above guidelines, and billed for separately before any exchange credit shall be provided.   Orders shipped and refused are non refundable and a $10 restocking fee will be accessed per item, shipping and handling is non-refundable and a 20% refusal fee shall apply.   For orders cancelled before shipment the greater of a 20% fee or a $10 per item restocking fee will be accessed and the shipping and handling fee shall not be refunded. Shipping and handling charges are non-refundable.   If you have met all the above criteria you will be credited pursuant to the policy outlined here.
